Le bloc de constitutionnalité en droit positif congolais

Contrairement au droit français qui offre, en l’absence d’un dispositif constitutionnel formel,  une passerelle au cadrage doctrinal du bloc de constitutionnalité inspirant, par la suite, l’activité du Conseil constitutionnel, le droit congolais propose une démarche différente situant l’origine du concept à la nomenclature des normes soumises au contrôle de constitutionnalité pour que par sa jurisprudence, le juge s’autorise d’élargir son domaine d’intervention. Par cette extension des compétences de la Cour constitutionnelle, on arrive à se faire l’idée que le bloc de constitutionnalité est, finalement, ce que le juge décide, sa ferveur s’inscrivant toujours dans la recherche permanente des réelles intentions du constituant et de ses objectifs.

De même, alors que le droit français prédispose le bloc de constitutionnalité en un ensemble des normes et principes considérés comme supérieurs et fondamentaux pour être garantis par la Constitution d’une supériorité que le juge se charge de protéger, le droit congolais fait de la Constitution la Loi suprême à laquelle doivent se conformes les autres normes qui lui sont inférieures. L’activité du juge se positionne donc dans l’unique et seul cadre de la Constitution, la Cour constitutionnelle disposant, dans ce cas,  non pas d’une seule recette, mais bien de plusieurs.
