« Conventionnisme constitutionnel: entre rupture et pérennité de la Constitution en Afrique francophone » in FALL A.B, Le droit constitutionnel en Afrique, Presses de l’Université de LYON, 2020.

Dans la mise en route du constitutionnalisme en Afrique, les accords politiques ont pu être pointés comme capables d’insuffler une nouvelle dynamique, dans la perception du droit constitutionnel. Il demeure qu’en raison de sa temporalité, le phénomène ne soit pas toujours en cohérence avec la suprématie de la Constitution, au point d’écorcher sa stabilité et, donc, sa pérennité.

On doit, à l’évidence, reconnaitre le caractère relatif de la crainte, tant la place des accords politiques dans l’ordonnancement constitutionnel africain est une recette qui n’a pas encore fini d’être explorée,l’acceptation dans la pyramide normative devient une nécessité.

L’observation aboutit à l’idée que  c’est moins la normativité du phénomène qui pose problème, mais bien le profil qu’il prend ou s’adjuge à côté de la Constitution en vigueur.

Aussi, la réflexion ne doit-elle pas trop se focaliser sur une opposition stérile, pour encourager une convergence d’approches et d’objectifs autour de l’unité et la pérénnité de la Constitution. La démarche doit, autant que faire se peut, rendre possible la justiciabilité d’un accord politique contraire à la Constitution.
